Terms & Conditions
1. Scope and Acceptance
These Terms and Conditions (“Agreement”) govern all transactions conducted through the website MyLoveSong.in (“the Platform”), operated by NBA Orip LLC, 30 N Gould St, Ste R, Sheridan, WY 82801, USA.
By accessing or using the Platform, each user (“Customer”) acknowledges full acceptance of these Terms without limitation or qualification.
2. Nature of Service
MyLoveSong.in provides personalized song creation and related digital-media services.
Songs are individually produced through a proprietary digital creative system that processes customer-provided information (including narratives, dedications, and other personal data) to generate a tailored composition.
All outputs are delivered exclusively in digital form (e.g., MP3 or WAV files) and constitute a custom product made specifically for the ordering Customer.
3. Orders and Payments
Orders are confirmed only upon successful receipt of payment through authorized processors such as Razorpay India or equivalent gateways.
Prices are displayed in the applicable currency and include transaction or processing charges where indicated.
The Company reserves the right to refuse or cancel any order prior to commencement of production in the event of payment anomalies or misuse of the Platform.
4. Delivery
Upon completion of production, digital files will be transmitted electronically to the Customer by means of secure download link or direct email delivery.
Where the Customer selects an optional distribution service (for example, upload to a third-party streaming platform), the Customer expressly authorizes MyLoveSong.in to act as intermediary for such submission.
Delivery timelines indicated on the Platform are estimates and not legally binding.
4a. Revisions
The Company provides up to two (2) complimentary revision rounds per order, limited to reasonable adjustments of lyrics, vocal delivery, arrangement balance, or timing consistent with the original brief.
Revision requests must be submitted via the on-site “Review” tab associated with the order or by email to review@mylovesong.in within seven (7) calendar days after first delivery of the digital file.
Additional revision rounds, material deviations from the initial brief, or requests received outside the foregoing window may be subject to additional fees and extended timelines at the Company’s discretion.
Revisions do not alter the non-refundability provisions under Section 5 and shall not constitute a waiver of any rights reserved by the Company.
5. Refunds and Cancellations
As each product is uniquely created according to customer-specific data, no refund, withdrawal, or cancellation shall be granted once the production process has commenced.
In cases of verified technical failure in file transmission, MyLoveSong.in shall, at its sole discretion, provide redelivery of the digital file or equivalent replacement.
6. Intellectual Property
All musical compositions, lyrics, arrangements, and derivative outputs produced via the Platform remain the exclusive intellectual property of NBA Orip LLC.
The Customer receives a limited, non-transferable, non-exclusive license strictly for private and personal use of the purchased work.
Reproduction, publication, sale, resale, public performance, or commercial exploitation of any content is prohibited unless accompanied by a separately purchased Commercial Use License or written authorization from the Company.
7. Commercial Use License
Customers may obtain an optional Commercial Use License at checkout or upon subsequent written request.
This license extends limited rights to use the acquired composition for monetized or publicly distributed purposes, including but not limited to streaming platforms, advertisements, or promotional materials.
All such licenses remain non-exclusive and non-transferable; ownership of the master recording and composition remains with NBA Orip LLC.
The Customer assumes sole responsibility for compliance with all applicable copyright, distribution, and platform regulations.
8. Disclaimer of Originality
The creative process employed by the Platform may involve automated digital composition methodologies that integrate licensed generative technologies.
Consequently, MyLoveSong.in does not warrant that any composition will be entirely unique or devoid of similarity to pre-existing musical works.
The Customer expressly acknowledges that any resemblance or incidental likeness is unintentional and that MyLoveSong.in bears no liability for any claims, damages, or disputes arising therefrom.
9. Limitation of Liability
To the fullest extent permitted by law, NBA Orip LLC, its directors, affiliates, agents, and suppliers shall not be liable for:
(a) indirect, incidental, or consequential damages;
(b) loss of data, profit, or goodwill;
(c) third-party claims related to use, misuse, or distribution of any digital content.
The Company’s aggregate liability under any circumstance shall not exceed the total amount paid by the Customer for the relevant order.
10. Governing Law and Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of the State of Wyoming, USA, excluding conflict-of-law provisions.
Any dispute arising from or relating to these Terms shall be submitted exclusively to the competent courts of Sheridan County, Wyoming, USA.
